MatchYard Terms of Service & End User License Agreement

Welcome to MatchYard. These Terms of Service and End User License Agreement (the “Terms”) are a binding agreement between you and MatchYard (“MatchYard,” “we,” “us,” or “our”) governing your use of the MatchYard mobile application and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 17 years old to use MatchYard. By using the Service, you represent that you are 17 or older and that you have the legal capacity to enter into these Terms.

2. Your account

You are responsible for the information you provide and for all activity that occurs under your account. Keep your login credentials secure. Provide accurate information and keep it up to date. You may delete your account at any time from within the app (Profile → Delete Account); deletion is permanent and removes your profile, posts, chats, messages, and ratings.

3. Zero tolerance for objectionable content and abusive behavior

MatchYard has zero tolerance for objectionable content or abusive users. This is a core condition of using the Service.

You may not post, send, or share content that is, and you may not behave in a manner that is:

• harassing, bullying, threatening, hateful, or that incites violence;
• sexually explicit, pornographic, or that sexualizes minors in any way;
• defamatory, obscene, or otherwise offensive;
• discriminatory based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic;
• violent, graphic, or designed to shock or disgust;
• fraudulent, deceptive, spam, or a solicitation;
• an impersonation of another person or entity; or
• otherwise unlawful or objectionable.

We do not tolerate abusive users. We may remove objectionable content and suspend or terminate accounts without notice for any violation of this section. To support this, we provide tools to report objectionable content or abusive users and to block users directly within the app, and we act on reports of objectionable content by removing the content and ejecting the user who provided it, typically within 24 hours.

4. Acceptable use

In addition to Section 3, you agree not to:

• use the Service for any illegal purpose or in violation of any law;
• collect or harvest other users’ personal information;
• attempt to access accounts, data, or systems you are not authorized to access;
• interfere with, disrupt, reverse engineer, or attempt to circumvent any security or rate-limiting feature of the Service;
• use bots, scrapers, or other automated means to access the Service; or
• use the Service to send unsolicited messages or to facilitate any scam.

5. User-generated content

You retain ownership of the content you create (your profile, posts, messages, and ratings). By submitting content, you grant MatchYard a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content solely to operate and provide the Service (for example, showing your post to nearby users so they can connect with you). You are solely responsible for the content you submit and for your interactions with other users.

6. You are responsible for your interactions — real-world meetups carry risk

MatchYard helps people find sport partners. Meeting people you do not know carries real-world risk. MatchYard does not conduct criminal background checks or otherwise vet users, and we do not verify the identity, statements, or conduct of any user.

You are solely responsible for your interactions with other users, including any in-person meetup. Take sensible precautions: meet in public places, tell a friend where you are going, and trust your instincts. To the fullest extent permitted by law, MatchYard is not responsible or liable for the conduct of any user, on or off the Service, and is not liable for any loss, injury, or damage of any kind arising from your interactions with other users or from any in-person meeting arranged through the Service.

7. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, remove your content, and/or terminate your account at any time, with or without notice, if we believe you have violated these Terms (including Section 3), if required by law, or to protect the safety of our users or the integrity of the Service.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9. Limitation of liability

To the fullest extent permitted by law, MatchYard and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service or your interactions with other users.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to its conflict-of-laws rules. Any dispute will be resolved in the courts located in that jurisdiction.
